Well, you quoted some legal maxims.. Roughly:
A custom founded on a certain and reasonable ground supersedes the common law and while alienation may be restrained, yet it may be made with the consent of all those in whose favor it was restrained and any one may renounce a law introduced for his own benefit and that which is not otherwise permitted, necessity allows, and necessity makes a privilege which supersedes the law.

Not to go too deep into that - copyright law is quite straightforward in most of the countries. There are also Constitutional Court cases that have to be taken into account. But hey we are slipping a bit too deep. Sufficient to say that in correlation to a talk on this forum regarding piracy hurting the business,I just wanted to point out something many don’t know. For example, I legally cannot use Pierre’s photo in my photostream (although published here), without his consent…

Aha, one gots to love the power of google and wikipedia, making peoples first class professors. Not everything you read on the internet is the truth, ya know. Very often technical things get misinterpreted and subsequently those who taught a.k.a. these "internetteachers" are thus wrongly developing cognizance of the "students" intellectual (and well sought-after advancing ) activity. Reading that you loved throwing with latin phrases, I wrongly assumed that you had been tought latin in your highschool or university. Would it be any different, then you prolly would have omitted the word roughly. I wonder if you could explain me in layman terms what you think you rightly have been taught by the internetprof (including implications of the technical words you might or might not choose to use). Because what you now paraphrased casu quo restated from the internet would many in the know, consider as a tad unfamiliar. De jure and de facto are two different things both which have their place in a court of law, both which could, can and will be applied regarding copyright laws in a legal procedure.

Please state a court case in a copyright law in which de iure and de facto differs and de facto wins over de iure. Your argument is generally right but de facto it is close to impossible to change many times confirmed de jure practice. I do agree however that the change is the only certain thing in everything we do. I just don’t think your arguments would hold in such cases. (but admittedly this is only my non-expert opinion).
