A 47-year-old French man and a Swiss woman he met on Tinder were having sex during their second date when the man slipped his condom off without telling the woman — and now he's been convicted of rape.

Switzerland's highest court determined that the woman, whose lawyer calls this conviction "a first for Switzerland," would not have consented to sex with the man had she known he was not wearing protection, the Local reports. He was given a 12-month suspended sentence over the June 2015 incident, the Independent reports.

Broadly notes that this is the same controversy swirling around Julian Assange — two women accused him of intentionally taking off or tampering with condoms, without consent, during sex. Doing so is against the law in the UK, which found there were grounds for him to be extradited to Sweden to face rape charges over the incident.

As an expert explains, though, "a lot comes down to what can be proved in court. ... A jury would have to determine that he didn't have a reasonable belief in consent and just went ahead and did it anyway."

Yes and how proove a condom was really taken-off ? it's her words against his words !!!
And what about if a condom break or skid during the action ? It's also a rape ???
Some people make very stupid law, it's not so difficult for a women to keep a finger "on" the subject if she wants be sure the condom is here ...
IMHO this is something a women can control if she wants. Originaly as far I know, a rape is having sex without consent from begining to the end ( can start with a no and finish with a yes which is also different ) but if this woman accepted the sex with this man, WTF, why the condom is involved in the story !!!

Not sure i agree there. It should be rape if the woman for whatever reason doesen't consent in the middle of the act, and the man keeps going regardless

If she struggles and you hit her, leave marks on her, maybe one.
Nevertheless if she goes to the Police right after the act, unwashed and sue you, most people and Justice (a jury) would take her side and convict you as a rapist.

In fact the guy confessed. "It slipped off", then "I forgot to put it on".

It happens to me so often that the condom slip off !!!
For me a rape it's when a girl doesn't want sex intercourse with someone and his forced, but if she agree and a condom slip off from a dick where is the rape ???
It's like if a girl has AIDS, you know it, but you take risk to fuck her with a condom, then it broke and after you sue her because she was HIV positive !!!
